Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the Bike Community Malaysia ("BCM") platform at bcm.my. By registering an account or using this platform, you agree to be bound by these Terms. If you do not agree, do not use the platform.

1. Eligibility

• You must be at least 18 years of age to register.
• You must provide accurate, current, and complete information during registration.
• You must be a genuine bike, scooter, or motorcycle user or enthusiast.
• One account per person is allowed. Duplicate accounts will be suspended.

2. Account & Membership

• Accounts are subject to admin approval. BCM reserves the right to reject any application without reason.
• You are responsible for maintaining the confidentiality of your password.
• You must not share your account credentials with others.
• BCM reserves the right to suspend or terminate accounts that violate these Terms at any time.
• Membership is free and does not confer ownership of any part of the platform.

3. Code of Conduct

You agree not to use this platform to:

• Post false, misleading, or defamatory content
• Harass, threaten, or intimidate other members
• Share or promote illegal activities, including illegal road racing or reckless riding
• Impersonate another person or entity
• Attempt to gain unauthorised access to the system or other members' accounts
• Post spam, advertisements, or unsolicited promotions
• Upload content that violates copyright or intellectual property laws

Violation of the Code of Conduct may result in immediate account suspension or permanent ban, and may be reported to the relevant authorities.

4. Performance Rankings

• Ranking data (top speed, distance) submitted by members must be accurate and verified with valid GPS evidence.
• All data submitted to the rankings is understood to be recorded in a safe and lawful environment. BCM does not condone or encourage speeding on public roads.
• BCM admins reserve the right to reject, remove, or re-verify any ranking entry at any time.
• Submitting falsified or manipulated data constitutes a breach of these Terms and will result in account suspension.
• Your username, state, bike model, and performance record may be displayed publicly on the leaderboard. Plate numbers are visible to logged-in members only.

5. Ride Requests

• The ride request feature is a community notice board only. BCM is not a transport service, ride-hailing platform, or operator under the Land Public Transport Act 2010.
• BCM is not a party to any ride arrangement between members and accepts no liability for any outcome of such arrangements, including accidents, injuries, property damage, or disputes.
• Members participate in rides entirely at their own risk.
• All posted rides must comply with Malaysian road traffic laws. Posting rides intended for illegal racing or reckless group activities is prohibited.

6. Events

• Events posted on this platform are organised by BCM or its appointed event moderators.
• BCM reserves the right to cancel or modify events at any time.
• Attendance at any BCM event is voluntary and at the participant's own risk.
• Participants are responsible for their own safety, road-worthy vehicles, valid licences, and road tax & insurance when attending events.

7. User-Generated Content

• By posting content (ride requests, event comments, ranking data, images), you grant BCM a non-exclusive licence to display that content on the platform.
• You retain ownership of content you create, but you are solely responsible for ensuring it does not violate any laws or third-party rights.
• BCM may remove any content that violates these Terms without notice.

8. Limitation of Liability

To the maximum extent permitted by Malaysian law, BCM and its administrators shall not be liable for any direct, indirect, incidental, or consequential damages arising from:

• Use or inability to use the platform
• Any ride arrangements made through the platform
• Inaccurate information posted by members
• Temporary downtime, data loss, or technical errors

The platform is provided "as is" without warranty of any kind.

9. Privacy

Your use of this platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We comply with Malaysia's Personal Data Protection Act 2010 (PDPA).

10. Intellectual Property

The BCM name, logo, and all platform design elements are the intellectual property of Bike Community Malaysia. You may not reproduce, distribute, or use them without prior written permission.

11. Amendments

BCM reserves the right to amend these Terms at any time. Continued use of the platform after changes are posted constitutes acceptance of the updated Terms. We will endeavour to notify members of significant changes via WhatsApp or email.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the Malaysian courts.
